Joseph B. Hayes is named in the 1835 will of his father, Benjamin Hays
(Marion Probate Roll #374). The full name of Benjamin's wife has never been
proven, but in his will Benjamin gives her name as Elizabeth. The children of
Benjamin as named in his will: Sealy Allen, James, Joseph, William, Levy,
Elizabeth Martin, Jesse, and Sally Smith. Sons Joseph B. Hays and Levy Hays
named as executors.
Evelyn Elvington of Lake View, now deceased, compiled notes and family group
sheets on the Benjamin Hayes family, as well as many other local families.
One of her notes states that the wife of Benjamin Hayes was Elizabeth Rains,
but since Evelyn's notes contain no source for her assertion, the Rains
surname must remain a matter of conjecture only, and can only be viewed as a
clue.
In his will, Benjamin devised to his son Joseph "the plantation on Mill
Branch purchased from Thompson Barfield" which deed, unfortunately, was never
recorded at the courthouse. This appears to be the same land later owned by
Joseph B. Hayes' descendant, Mr. Truss Hayes. These lands include the
beautiful old homeplace in the huge pecan orchard on High Hill Road, and the
cemetery at High Hill where Joseph B. Hayes, his wife, and others of his
family are buried.
