DICTIONARY, 1980, defines "replevin" as: 1. "the recovery by a person of
goods claimed to be his, on his promise to test the matter in court and
give the goods up again if defeated; 2. the writ by which he takes over
the goods."
Marion Lentz instituted replevin proceedings in Justice Rice's court
yesterday against his divorced wife, Teresa Lentz, to obtain some household
goods valued at about $20 he alleged was his property. When the case came
to trial, Mrs. Lentz's attorneys, Miller & Hadley, moved to dismiss the
suit on the grounds that it was brought in Perry Township and the goods
were really in Bloomington Township. The court held the point to be good
as he had no jurisdiction in Bloomington Township and dismissed the
case. J. G. Harris, attorney for Lentz, refiled the suit in Bloomington
Township and secured possession of the goods.
