NEWTON ADAMS CALLED FOR TRIAL
Third of Whitecap Cases Now Before Judge Mellen
The case of Newton Adams, the third man on trial for the whipping of Harvey
McFarland, was called in court this moring...After argument for and against
continuance by the attorneys on each side, court adjourned until 5 o'clock
to await the return of Dr. Luzadder who was sent to the Snoddy home in the
south part of the county to report as to the exact condition of Mrs.
William Snoddy, an important witness who, it is said, is too ill to attend
court and give testimony.
A request for a change of venue having been denied by Judge Wilson in the
Newton Adams whitecap case, the next step of the defense was to ask for a
change of judge...The next move of the defense was to ask a continuance on
the grounds that two witnesses could not be secured--Mrs. William Snoddy,
who would testify that some of the accused defendants were at thome all
night, she being too sick to be in court; also because of the absence of
John Butcher who would testify as to the exact time that buggies were seen
passing south on the night of the whipping. It is said that Butcher is in
Illinois. and at the last trial it was necessary for him to have to be
brought into court by the sheriff...
