The highest level of proof in American jurisprudence is "beyond a
reasoable doubt" and is used in criminal cases.In this level of proof,
you must over come the presumption of innocence. Thus if paternity was
an issue in a rape case, you would have to prove the same, beyond a
reasonable doubt by genetic testing. The next highest level of proof is
"clear and convincing evidence." The lowest level of proof is "by a
preponderance of the evidence". This last standard of proof is used in
civil cases in American jurisprudence. It means that the proposition
being offered is more likely than not to be true.
