I don't think that such drastic action would be needed.

The people who complain about off list replies are genuinely concerned about
the effectiveness of the list and should not be punished for expressing
their concern. I have subscribed to other lists which are totally
ineffective as forums for the exchange of information and discussion because
almost all the replies were off list.

Maybe the tag line at the bottom of each message could contain a brief
explanation of this issue from time to time? Though I believe this tag line
is not included with digests?
