The terms of "fair use" would not apply in this circumstance, since the
provider of the service stands to obtain commerical benefit at the expense
of the copyright holder. It really is not a "fair use" issue. In spite of
the fact that the group indentifies itself as a non-profit organization
staffed by volunteers, that does not place them above the law. Just because
the convert the proceeds of their work to a non-profit purpose (i.e.,
further expanding the library of material that they violate).
To my knowledge, as publisher of a good number of the titles on the list,
but the copyright holder of only a few, no one has approached our firm or
our authors about any form of compensation for the use of their material for
commerical purpose.
I will notify some of the authors and publishers of the material in
copyright for them to take what action they please. I guess that the lawyer
letters will start flying.
I have no problem with their providing this service for titles that are in
the public domain, even if it was my dime that published them. Not illegal,
just unethical in my mind.
